2. Acceptance

By accessing the website, creating an account or entering into an engagement with MapleFundy, you agree to these Terms. Additional engagement-specific terms may apply. If an engagement letter conflicts with these Terms, the engagement letter governs the professional services concerned.

3. Eligibility

You must be at least the age of majority in your province or territory and legally capable of entering into a contract. You must provide accurate information and may only submit transaction, account and personal information that you are lawfully authorized to provide.

4. Services

MapleFundy provides blockchain transaction analysis, digital-asset tracing, compliance support and related consulting described in an accepted written engagement.

MapleFundy does not:

• Hold or safeguard client cryptocurrency or money
• Operate a cryptocurrency exchange or wallet
• Execute purchases, sales, swaps or transfers
• Freeze, seize or reverse blockchain transactions
• Provide legal, tax or investment advice
• Act as law enforcement or a government regulator
• Guarantee identification, freezing or recovery

5. Engagement formation

Submitting an inquiry or creating an account does not require MapleFundy to accept a matter. An engagement begins only when MapleFundy confirms acceptance and the applicable written terms have been agreed.

6. Client responsibilities

You must provide accurate and complete information; preserve original records; avoid altering or fabricating evidence; protect passwords, private keys and seed phrases; obtain necessary legal advice; and report material changes promptly. Never provide MapleFundy with a private key, wallet seed phrase or account password.

7. Fees and taxes

Fees, applicable taxes, payment dates and included deliverables will be disclosed before paid work begins. MapleFundy will not require cryptocurrency to establish transaction flow, activate a wallet, release an account or unlock allegedly recovered funds. Third-party legal, court, exchange, expert or government costs are not included unless expressly stated.

8. No guarantee

Blockchain analysis is subject to technical, evidentiary and legal limitations. No statement, assessment, dashboard status or estimated completion date guarantees identification, freezing, seizure, return or recovery of an asset.

9. Third parties

MapleFundy does not control exchanges, banks, custodians, blockchains, public authorities, courts or other third parties. References to third-party names do not imply affiliation or endorsement.

10. Intellectual property

MapleFundy retains ownership of its general methods, templates, software and pre-existing materials. Subject to payment, the client may use the engagement-specific report for the purposes described in the engagement.

11. Confidentiality and privacy

We handle personal information according to our Privacy Policy and applicable Canadian privacy law. Confidentiality is subject to lawful disclosure requirements, protection of legal rights and any reporting duty imposed by law.

12. Acceptable use

You must not use the website or services to commit unlawful activity; deceive or impersonate; obtain information without lawful authority; evade sanctions; introduce malicious code; interfere with security; or submit false or misleading information.

13. Suspension and termination

We may reject, suspend or terminate an account or engagement where reasonably necessary to address security, non-payment, legal risk, false information, prohibited use or breach. Refunds and outstanding fees are determined under the engagement and applicable consumer law.

14. Disclaimers

Website information is general and is not legal, tax, financial or investment advice. Nothing in these Terms excludes a right or remedy that cannot lawfully be excluded.

15. Limitation of liability

Any engagement-specific limitation must appear in the written engagement and is subject to applicable law. MapleFundy is not responsible for losses caused solely by market movements, client disclosure of credentials, incorrect client information or independent third-party actions.

16. Changes

We may update these Terms prospectively. Material changes will be communicated through the website, account or email where appropriate.

17. Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without limiting mandatory consumer rights applicable in another province or territory. Subject to applicable consumer law, Ontario courts have jurisdiction.
